Waiver

Those participating in the Celery Stix Fat-loss Challenge, herein called Participant, agrees that Celery Stix is sponsoring the Fat-loss Challenge and no obligation is set forth to purchase any of the services offered by Celery Stix or its sponsors. If the Participant wishes to purchase services, she will not be given any preferential treatment with regards to the Fat-loss Challenge.

Participant agrees that the Fat-loss Challenge is strictly for entertainment purposes and Participant is solely responsible for her exercise and diet actions. Participant is encouraged to consult a physician before registering for the Fat-loss Challenge.

Participant understands that the Fat-loss Challenge is not medically supervised and is intended for people with no medical conditions (physical or psychological). If Participant has an existing medical condition, before registering for the Fat-loss Challenge, Participant will present the Challenge's moderator with a Physician's Release Form, signed and dated by Participant's personal physician. This form represents the participant's physician's approval to participate in the Fat-loss Challenge.

Participant agrees that she is participating in the Fat-loss Challenge at her own risk. Participant further agrees to hold harmless Celery Stix (a.k.a. Lisa Withers, Amy Carr, Becky Morris), its agents, and its successors from any and all claims, causes of action, suits or liability, costs and expenses (including, without limitation, reasonable attorneys' fees) arising out of, or in connection with, any loss, personal injury, death, or other damage that I may incur or suffer by reason or as a result of my enrollment or participation in the Celery Stix Challenge.

Participant understands that the payout schedule will be based on the number of registrants as outlined on the Celery Stix website.

Participant understands that if she is among those receiving payouts, she will be responsible for her own income tax filing.

Participant agrees to pay the registration fee to enter the Fat-loss Challenge. PARTICIPANT MAY CANCEL AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY, AFTER THE DATE OF THE TRANSACTION. If enacted, a refund of the registration fee will be returned to the participant minus a $10.00 processing fee. After midnight of the third business day, no refunds will be given for any reason.

Should a situation arise that warrants the cancellation of the Fat-loss Challenge, then a full refund will be given to all would-be participants. Situation is defined as any event, controllable or uncontrollable, that Celery Stix, at its sole discretion, deems dangerous, malicious, financially burdensome, or unbecoming for the Participant or Celery Stix.

Participant may be disqualified from the Fat-loss Challenge if, but not limited to: threatening another participant, cheating as deemed by the Challenge's moderator, posting explicity messages on the Celery Stix website, bribing other participants, demonstrating unruly conduct at the weigh-in, taking any weight-loss medications or stimulants, or undergoing any weight-loss surgeries during the challenge period. Should Participant be disqualified, no refund will be given.

Participant understands that the Fat-loss Challenge is not simply a weight-reduction contest. Participant is encouraged to focus on fat loss over weight. Participant agrees that fat reductions are calculated on a percentage of overall body fat.

Participant understands that it will be required that her body fat and scale weight will be tested at each weigh-in. Body fat will be tested using the skin fold calibers. Participant understands that four pinches will be required at each weigh-in. The pinches will be conducted on the right side of the body (unless special consideration is needed) and will take place on the bicep, tricep, iliac crest (right above the hip bone), and subscapularis (right below the shoulder blade). In the event that a participant is deemed, at the sole discretion of Challenge's moderator, unable to be pinched, the alternative method of circumference body fat measurement will be chosen and used for the duration of the Fat-loss Challenge.

Participant is asked to wear loose fitting clothing to each weigh-in to ensure discreet pinching. If participant, at the discretion of Challenge's moderator, is unable to be pinched discreetly then the participant forfeits that weigh-in and will not be pinched and her weight will not be recorded. Participant will still be eligible for future weigh-ins.

Participant understands that the Fat-loss Challenge will run for 42 days from the time of her first weigh-in. The challenge will end 7 days from the last participant's final weigh-in.

Participant agrees that if she fails to appear for her final weigh-in, she forfeits the Fat-loss Challenge in its entirety. Participant understands that in the event of a forfeit, she will not receive any compensation for monies paid into or used for the purpose of participating in the Fat-loss Challenge.

Participant agrees to allow her first name, last initial, any pictures/video taken of them during the Fat-loss Challenge, and her Fat-loss Challenge statistics to be posted on the Internet at www.celerystix.net. Participant agrees that her Fat-loss Challenge statistics and pictures become the property of Celery Stix and can be used at Celery Stix's sole discretion.

Addendum

Participant understands that the Fat-loss Challenge will run for 42 days from the time of her first weigh-in. The challenge will end 7 days from the last participant's final weigh-in.
